Acceptance of Terms

By accessing and using Snowmark Gifts' website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These terms apply to all visitors, users, and others who access or use our services, including our design tools, customization features, and fulfillment services.

Service Description

Snowmark Gifts provides a platform for creating and ordering personalized New Year gifts through our curated catalog of engravable goods, custom design tools, and network of local craft partners in Japan.

Our services include instant design previews, customization options, gift wrapping, and coordination with local artisans for laser engraving, embroidery, and printing services.

User Accounts and Registration

To access certain features of our service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Orders and Payment

All orders are subject to acceptance by Snowmark Gifts. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase or inaccuracies in product or pricing information.

Payment is due at the time of order placement. We accept major credit cards and other payment methods as displayed during checkout. All prices are in Japanese Yen unless otherwise specified.

Custom Design and Personalization

You retain ownership of any original designs or content you create using our design tools. However, you grant us a license to use your designs solely for the purpose of fulfilling your orders through our craft partners.

You are responsible for ensuring that your custom designs do not infringe on any third-party intellectual property rights or contain inappropriate content.

Fulfillment and Delivery

We work with local craft partners to fulfill your personalized orders. Delivery times may vary based on customization complexity and partner availability. We will provide estimated delivery dates at the time of order.

Risk of loss and title for items purchased pass to you upon delivery to the carrier. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

Returns and Exchanges

Due to the personalized nature of our products, returns are generally not accepted unless the item is defective or significantly different from what was ordered. Custom-designed items cannot be returned unless there was an error in production.

If you receive a defective or incorrect item, please contact us within 7 days of delivery to arrange for a replacement or refund.

Intellectual Property Rights

The Snowmark Gifts website, including its design, text, graphics, and other content, is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Our design tools and preview technology are proprietary and protected by intellectual property laws.

User Conduct

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our website or interfere with any other party's use of our services.

You may not attempt to gain unauthorized access to any portion of our website or any other systems or networks connected to our services.

Corporate and Bulk Orders

Special terms may apply to corporate and bulk orders. These will be communicated separately and may include different pricing, delivery terms, and customization options.

Corporate accounts may be subject to additional verification requirements and credit terms as agreed upon separately.

Limitation of Liability

Snowmark Gifts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for all claims arising from or relating to our services shall not exceed the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Snowmark Gifts and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of our services or violation of these terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Osaka, Japan.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the updated terms on our website and updating the effective date.

Your continued use of our services after any changes constitutes acceptance of the new terms.
